General Terms and Conditions (GTC)

Introduction

The e-commerce site www.tennymeng.com (hereinafter referred to as the "Site") is an online platform accessible via the Internet, open to all users of this medium (hereinafter referred to as "Users"). It is operated by the micro-enterprise Tenny Meng (hereinafter referred to as "Tenny Meng"), headquartered at 4 rue du Quadrille 83990 Saint-Tropez, registered with the Trade and Companies Register of Fréjus under number 949 483 069.

The Site enables Tenny Meng to offer for sale products and textile accessories under the Tenny Meng brand (hereinafter referred to as the "Products") to users browsing the Site (hereinafter referred to as the "Customers"). For the purposes of these terms and conditions, it is agreed that the Customer and Tenny Meng will be collectively referred to as the "Parties" and individually as a "Party", and that the customer who has placed an order will be referred to as the "Buyer".

Any order of a Product offered on the Site implies acceptance by the Buyer of these General Terms and Conditions of Sale (GTCS). Tenny Meng reserves the right to modify these Terms and Conditions at any time by publishing a new version on the Site. The applicable terms and conditions are those in force at the date of purchase.

Article 1. Purpose

These General Terms and Conditions of Sale govern the rights and obligations of the Parties arising from the online sale of Products offered on the Site, and apply to the exclusion of any other document.

Article 2. Products - Prices

2.1 Products

Only the products presented on the Site on the day of consultation by the Customer are offered for sale. The products offered are limited to the European zone. Products and prices are available, subject to availability, as long as they are proposed on the Site.

2.2 Price list

Prices are indicated in Euros, all taxes included. The prices applied are those displayed on the Site at the time the order is placed. The amount of the flat-rate preparation and delivery charges will be communicated to the customer on the order summary before validation of the said document. Please note that shipments to destinations outside the European Community are subject to import taxes and customs duties (DDU Deliver Duties Unpaid) according to the regulations of your country of origin.

Article 3. Placing an order

3.1 Order registration

Customers wishing to place an order select the item(s) of their choice by clicking on "Add to basket". At any time, the customer may :

  • Check the number of products in your basket and obtain detailed information on each item by clicking on "My basket".

  • A new Customer must fill in all the information fields required to create his/her customer account. Customers must fill in the form provided, which will contain the information needed to identify themselves, in particular their e-mail address and a password to enable them to connect to the site. Customers who already have a password must log in after clicking on "Confirm", entering their e-mail address and password. The customer accepts that this method of identification can prove his/her identity. This information is required for order processing, delivery and billing. Once the order has been placed, and all the required information has been entered by the Customer, the latter will have read and accepted the general terms and conditions of sale by ticking the appropriate box.

3.2 Order validation

Confirmation of the shopping basket constitutes an electronic signature. This signature is equivalent to a handwritten signature and is proof of the integrity of the order and of the amount due for the said order. Once the order has been validated, the Customer becomes the Buyer. Notwithstanding the application of article R624-3 of the French Penal Code, the Customer may pay by credit card (Carte Bleue, Visa, Eurocard/Mastercard). If the Customer wishes to pay by credit card, he/she must provide the credit card number. The card type, expiry date and CVV code must also be provided.

3.3 Payment

The amount due by the Buyer is the total amount indicated on the order summary. In all cases, the amount debited will correspond to the Product(s) to be delivered. When selecting a credit card as a means of payment, the Buyer will be automatically redirected to STRIPE's secure payment server. Payment is made exclusively by credit card (Carte Bleue, Visa, Eurocard/Mastercard) at the time of your order. Your credit card will be debited no later than six (6) days after your order has been placed, in the currency of the order.

You can make your purchases with complete peace of mind, since the confidentiality of banking information transmitted via the site to an authorized banking institution is carried out in a secure environment (SSL protocol) through our partner STRIPE.

Payment card numbers are not stored on our site, but on the secure site of the STRIPE banking institution.

As part of the electronic payment process and to prevent fraudulent use of online payment methods, we check the reliability of the information you provide when registering your order.

3.4 Order acknowledgement

Once payment has been made, a document summarizing the order is sent to the Buyer's e-mail address. This document serves as an acknowledgement of receipt and summarizes all the constituent elements of the contract between the parties.

3.5 Refusal to process an order

Tenny Meng reserves the right to withdraw at any time any Product displayed on the Site and to replace or modify any content or information appearing on the Site. Despite Tenny Meng's best efforts to satisfy its customers' expectations, Tenny Meng may refuse to process an Order after having sent the Customer the confirmation e-mail summarizing the Order.

Tenny Meng shall not be liable to the Customer or any third party for the consequences of the removal of a Product from the Site, or the replacement or modification of any content or information appearing on this Site, or the refusal to process an Order after the confirmation email summarizing the Order has been sent.

Tenny Meng also reserves the right to refuse or cancel an Order from a customer with whom it has a dispute over payment of a previous order.

Article 4. Delivery

Tenny Meng will make every effort to ensure that the order is delivered within an average of 1 to 2 weeks from the day after the validation of the Buyer's order. Orders placed on the www.tennymeng.com website on Fridays, Saturdays or Sundays will be processed on the following Monday. Orders placed on the www.tennymeng.com site on public holidays other than Fridays, Saturdays and Sundays will also be processed on the next working day. Products ordered by the Buyer will only be delivered within Europe to the address indicated by the Buyer on the order validation page, accompanied by a delivery note. The Buyer has the option of having the products delivered to an address other than his/her own. Delivery will not be guaranteed in the event of force majeure, transport strikes and/or disruption of postal services.

Article 5. Right of withdrawal

The Buyer has a period of fourteen (14) working days from delivery to notify Tenny Meng of his wish to return the Product(s) ordered at his expense and to send them back. If the above conditions are met, Tenny Meng will refund the Buyer the total amount of his order (price of the Products and shipping costs) according to the payment method used at the time of the order.

Article 6. Warranties and after-sales service

The products sold are covered by the legal guarantee of conformity and the legal guarantee of hidden defects in accordance with the provisions of articles L.217-4 to L.217-14 of the French Consumer Code and articles 1641 to 1649 of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.

Article 7. Personal data

The information collected by Tenny Meng during a Buyer's order is necessary to manage the transaction and to this end may be communicated in whole or in part to Tenny Meng's service providers involved in the execution of the order. The Buyer is informed that the same personal data may also be collected by an organization in charge of analyzing orders and combating credit card fraud.

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, and the General Data Protection Regulation (RGPD), the Buyer has the right to access, rectify, delete and object to personal data concerning him or her. Article 8. Intellectual property rights

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of Tenny Meng. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

Article 9. Mediation and settlement of disputes

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Tenny Meng adheres to the Mediation Service. After prior written application by consumers to Tenny Meng, the Mediation Service may be contacted for any consumer dispute which has not been settled.

Article 10. Applicable law

These GCS are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. Failing this, the French courts shall have sole jurisdiction.
